Effective 25 September 2026. Published 11 September 2026. Until then, the version effective 11 September 2026 applies.
1. Who we are
This website, pivotalmotion.physio, is operated by Pivotal Motion Physiotherapy Pty Ltd (ABN 21 155 577 834), trading as Pivotal Motion Physiotherapy. In these terms, “we”, “us” and “our” mean Pivotal Motion Physiotherapy Pty Ltd, and “you” means any person who visits or uses this website.
Our practice is located at 240 Enoggera Road, Newmarket QLD 4051, Australia. You can reach us on (07) 3352 5116 or at admin@pivotalmotion.com.au.
2. Your agreement to these terms
By visiting or using this website you agree to these Website Terms of Use. If you do not agree with them, please do not use the website.
If you book an appointment through this website, our Online Booking Terms and Conditions also apply to that booking. If there is any inconsistency between these terms and the Online Booking Terms and Conditions in relation to a booking, the Online Booking Terms and Conditions apply.
3. Changes to these terms
We may update these terms from time to time, for example when our services change or when the law changes. The version published on this page is always the current one.
Where a change is material, we will publish the updated terms before the change takes effect. Changes are not retrospective. The version in force when you made a booking is the version that governs that booking. If you do not accept an update, please stop using the website.
4. Website content is general information, not clinical advice
Everything on this website, including our service pages, condition pages, blog articles, exercise information, videos and downloadable resources, is provided as general health information only. It is not a physiotherapy assessment, a diagnosis, a treatment plan, or personal clinical advice, and it is not a substitute for a consultation with a registered health practitioner who has examined you.
General information cannot take account of your own history, symptoms, other health conditions, medications or goals. Please do not use this website to diagnose yourself, to decide whether to start or stop treatment, or to begin an exercise program without appropriate advice. If you are unsure whether something here applies to you, book an appointment or speak to your doctor or another qualified health practitioner.
Exercises and self management information on this site are not suitable for everyone. Stop immediately and seek advice if an activity causes pain, dizziness, numbness or any symptom that concerns you.
5. No guarantee of outcome
Physiotherapy, exercise science, rehabilitation and injury prevention services depend on many factors, including the nature and severity of your condition, other health conditions, and how a program is followed. We do not promise, guarantee or predict any particular clinical result, recovery time or outcome, and nothing on this website should be read as doing so. Our practitioners will discuss expected benefits, risks and reasonable alternatives with you as part of your care.
6. In an emergency
This website is not monitored for urgent or emergency contact. If you have a medical emergency, call 000 immediately or go to your nearest emergency department. Do not use our website, our online booking system or email to report an emergency or an urgent change in your condition.
7. Booking an appointment
You can request an appointment through the online booking system on this website. Making a booking request does not create a practitioner and patient relationship. That relationship begins only when a practitioner accepts your appointment, meets with you and carries out an assessment. Please read our Online Booking Terms and Conditions before you book.
8. How you may use this website
You may view, print and download material from this website for your own personal, non commercial use, and for your own health information. You must keep any copyright or ownership notices intact.
You must not:
- use the website for any unlawful purpose, or in a way that breaches any law or infringes anyone else’s rights;
- copy, republish, sell, license or commercially exploit any part of the website without our written permission;
- use any automated system to scrape, harvest or copy the site or its content, except for standard search engine indexing;
- attempt to gain unauthorised access to the website or any system connected to it, or interfere with its normal operation, including by introducing a virus or malicious code;
- submit false, misleading or another person’s information through any form on the website; or
- post or transmit anything defamatory, harassing, discriminatory or obscene, or that discloses another person’s personal or health information without their consent.
We may restrict or block access to the website if we reasonably believe you have breached these terms.
9. Suspension and termination (website access and bookings)
9.1 Our right to suspend, restrict or terminate access
We may, at any time and without notice, suspend, restrict or terminate your access to all or part of this website (including blocking IP addresses or accounts) if we reasonably believe that:
(a) you have breached these terms;
(b) you have used (or attempted to use) the website unlawfully, fraudulently or in a way that may cause harm to us, our staff, our patients or any other person;
(c) you have attempted to interfere with the security, availability or proper operation of the website (including by scraping, probing, scanning, introducing malware, or attempting unauthorised access);
(d) we are required to do so by law, a regulator, or a court; or
(e) it is otherwise reasonably necessary to protect our legitimate interests, including to prevent harm or manage security risk.
9.2 Removal of content
If you submit, upload, transmit or otherwise make available any content or material through the website, we may remove, hide or disable access to that content at any time and without notice.
9.3 Bookings
If we reasonably believe you have breached these terms or misused the website or booking system, we may refuse to accept a booking request, cancel or reschedule a booking, or require bookings to be made by telephone instead of online. Any such action will be taken subject to your non-excludable rights under the Australian Consumer Law.
9.4 General
Our failure to exercise, or delay in exercising, any right under this clause does not operate as a waiver of that right.
Clauses relating to intellectual property, privacy, disclaimers, limitation of liability, indemnities, and governing law and jurisdiction survive suspension or termination of access to the website, to the extent they are intended to do so.
Nothing in this clause excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
10. User indemnity
To the maximum extent permitted by law, you indemnify us and our directors, officers, employees and contractors against any loss, damage, liability, cost or expense (including reasonable legal costs on a full indemnity basis) suffered or incurred by any of them arising out of or in connection with:
(a) your breach of these terms;
(b) your unlawful, negligent or wilful act or omission in connection with your access to or use of the website;
(c) any content, information or material you submit, upload, transmit or otherwise make available to us through the website (including any allegation that it infringes a third party’s intellectual property rights, breaches confidentiality or is defamatory);
(d) your misuse of the website, including introducing malware, attempting unauthorised access, or interfering with the website’s security or operation; and
(e) any claim by a third party arising from matters in paragraphs (a) to (d) above.
This indemnity does not apply to the extent that the relevant loss is caused or contributed to by our negligence, fraud or breach of these terms, or to the extent it would exclude, restrict or modify any guarantee, right or remedy you have under the Australian Consumer Law or any other applicable law which cannot lawfully be excluded, restricted or modified.
11. Our intellectual property
Unless we say otherwise, all content on this website, including text, images, photographs, video, graphics, page layouts, exercise material and patient resources, is owned by or licensed to Pivotal Motion Physiotherapy Pty Ltd and is protected by Australian copyright law. Our business name, logo and branding are our property and may not be used without our written permission.
Nothing on this website transfers ownership of, or grants you a licence to use, our intellectual property beyond the limited personal use described in clause 8.
If you believe material on this site infringes your copyright, please contact us at admin@pivotalmotion.com.au with details and we will review it promptly.
12. Links and content from other organisations
This website may link to, or embed content from, other websites and services that we do not control, such as health information sites, professional bodies, funding bodies, video platforms, mapping services and our online booking system. Those links are provided for convenience only. A link is not an endorsement, and we are not responsible for the content, accuracy, availability, privacy practices or terms of any third party site. Your use of a third party site is governed by that site’s own terms and privacy policy.
13. Comments, reviews and social media
This website does not accept comments, reviews, uploads or any other content from visitors for publication, and we do not publish what you send us. Anything you send through a website form, our chat assistant or email comes to us privately, is used to respond to you, and is handled under our Privacy Policy.
As a registered health practitioner business, we are regulated by the Health Practitioner Regulation National Law and by the Ahpra Guidelines for advertising a regulated health service. The National Law does not allow us to use testimonials about clinical care or clinical outcomes in our advertising. For that reason:
- we will not publish or promote patient comments about clinical care, treatment or results on this website;
- if you send us feedback about your care, we will treat it as feedback and will not publish it as advertising; and
- we will not offer any inducement in exchange for a review or a testimonial.
Pages we control. Where we operate a social media page or account, that page is advertising for the purposes of the National Law. We are responsible for testimonials that appear on it, including ones posted by other people. If a comment on a page we control refers to clinical care, treatment or results, those rules require us to remove or hide it, or to turn off the function that allows it. That is not a judgement about you or about your experience.
The law does not set a deadline for doing it. We commit to acting within 7 days of becoming aware of the comment. That is our own service commitment, and our Social Media Disclaimer states the same one.
Sites we do not control. You are free to share your own honest experience on a third party review site such as Google or a health directory. We do not control those sites. We are not responsible for what other people publish there, and we cannot always have that material changed or removed.
If you have a concern about your care, we would much rather you raised it with us directly. See clause 17.
14. Privacy
We handle personal information and health information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains what we collect, why, who we share it with, how we hold it, and how you can access or correct it.
Please do not send us detailed clinical information, images of an injury, or other sensitive information through website forms or ordinary email. Email is not a secure channel. Our Website Security Statement has more detail.
15. Website availability
We aim to keep this website available and current. We cannot promise that it will be uninterrupted, error free, free of viruses, or that any particular content will remain available. We may change, suspend, or withdraw all or part of the website at any time, including for maintenance, security or redevelopment.
We take reasonable care to make sure the health information we publish is accurate at the time of publication. Health knowledge changes, and content can become out of date. Publication dates are shown on our articles where available.
16. Your rights under the Australian Consumer Law, and limitation of liability
16.1 Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded, restricted or modified.
16.2 Website use only (not clinical care)
This clause 16 applies only to your access to and use of this website (including the content on it). It does not affect your rights or our obligations in relation to clinical care you receive from us at the practice or by telehealth.
16.3 No exclusion of certain liability
Nothing in these terms limits or excludes our liability for:
(a) death or personal injury caused by our negligence; or
(b) fraud.
16.4 Exclusions and limitations for website use (to the extent permitted)
To the maximum extent permitted by law, and subject to clauses 16.1 to 16.3, we are not liable for any loss or damage arising out of or in connection with your access to, use of, or inability to use this website (including any content on it), where that loss or damage is not caused or contributed to by our breach of these terms or our failure to comply with a non-excludable legal obligation.
16.5 Indirect and consequential loss
To the maximum extent permitted by law, and subject to clauses 16.1 to 16.3, we are not liable for any indirect, consequential or special loss or damage, or any loss of profit, loss of revenue, loss of opportunity, loss of goodwill or business interruption arising out of or in connection with your use of this website.
16.6 Liability cap for website use
To the maximum extent permitted by law, and subject to clauses 16.1 to 16.3, our total aggregate liability to you for any claim arising out of or in connection with your use of this website (whether in contract, tort (including negligence), statute or otherwise) is limited to AUD $100.
17. Feedback and complaints
If you are unhappy with any part of our service, please tell us. You can contact us on (07) 3352 5116 or at admin@pivotalmotion.com.au. We will acknowledge your complaint within 5 business days and give you a written response within 20 business days.
You can also raise a concern with an external body at any time, and you do not have to come to us first.
In Queensland, complaints about a health service, and about the conduct of a registered health practitioner, go to the Office of the Health Ombudsman (oho.qld.gov.au, 133 646). It is the single entry point for health service complaints in Queensland, and it refers practitioner conduct matters to the Australian Health Practitioner Regulation Agency where that is appropriate.
If you receive services from us under the NDIS, you can complain to the NDIS Quality and Safeguards Commission (ndiscommission.gov.au) at any time.
Privacy concerns can be raised with the Office of the Australian Information Commissioner (oaic.gov.au, 1300 363 992).
18. General
These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of Queensland and the courts that can hear appeals from them.
If any part of these terms is found to be invalid or unenforceable, that part is severed and the rest of the terms continue to apply.
Our failure to enforce a term at any time does not waive our right to enforce it later.
Entire agreement: These terms (together with any other terms and policies referred to in them) constitute the entire agreement between you and us in relation to your use of the website and supersede all prior understandings, representations and agreements about that subject matter.
Assignment/transfer: We may assign or transfer our rights and obligations under these terms to another person or entity without your consent, and you must not assign or transfer your rights or obligations under these terms without our prior written consent.
