Please read this before you give us your details.
Who is collecting your information
Pivotal Motion Physiotherapy Pty Ltd, at the address above, is collecting the information you provide on this form.
What we are collecting and why
We collect your contact and identity details, your health fund, DVA, NDIS or WorkCover Queensland details where they apply, and information about your health. That includes your injury or condition, your medical history, your medications, your assessment results and your treatment notes.
Information about your health is sensitive information under the Privacy Act 1988 (Cth). We only collect it with your consent, or where the law requires or allows us to.
We collect it so we can assess and treat you safely, plan and update your care, and keep the clinical record we are required by law to keep. We also use it to contact you about your appointments, to bill you, and to claim on your behalf from your funder or insurer.
Software that helps write up your notes. We use software that listens to the conversation during your appointment and produces a draft set of clinical notes, so that your practitioner can concentrate on you rather than on typing. Your practitioner will tell you before it is used and ask whether you are comfortable with it. You can say no, either at a single appointment or as a standing preference on your file, and it will not affect your care or how you are treated.
Where the law requires us to collect it
Some of what we collect is required or authorised by law. Where you are treated under a WorkCover Queensland claim, collection and reporting requirements arise under the Workers’ Compensation and Rehabilitation Act 2003 (Qld). Where your treatment is funded through the NDIS, they arise under the National Disability Insurance Scheme Act 2013 (Cth).
What happens if you do not give it to us
You do not have to give us your information. If you do not, we may not be able to treat you safely. We may also be unable to treat you under a funded arrangement such as WorkCover Queensland, the NDIS or DVA. Those bodies require us to collect and report certain information as a condition of funding your care.
Who we usually share it with
Depending on your circumstances, we may share your information with:
- other practitioners inside our clinic who are involved in your care
- your GP, specialist or other treating health practitioners, where you have agreed to that
- WorkCover Queensland, the National Disability Insurance Agency and NDIS plan managers, the Department of Veterans’ Affairs, your private health fund, and other insurers, where they are funding your treatment
- your employer or a rehabilitation provider, where you are receiving return to work support and you have agreed to that
- our practice management software provider PracSuite, and our payment providers Tyro and Commonwealth Bank Smart Health. We do not store your card details at the clinic.
- the clinical documentation software described above, Heidi and Lyrebird, where you have agreed to it being used in your appointment
- anyone else you authorise, and anyone we are required or permitted to disclose to by law
We do not sell your information.
Overseas
Some of the software we use is delivered over the internet, so your information may be stored on servers outside Australia. Before we disclose your information to an overseas recipient, we take reasonable steps to make sure they handle it in a way that is consistent with the Australian Privacy Principles.
Your rights
You can ask to see the information we hold about you, and ask us to correct it. You can also complain if you think we have mishandled it. Our Privacy Policy explains how.
Privacy questions and requests go to admin@pivotalmotion.com.au.
You can also go to an external body at any time. Privacy concerns go to the Office of the Australian Information Commissioner (oaic.gov.au, 1300 363 992). Concerns about a health service, or about the conduct of a registered health practitioner, go to the Office of the Health Ombudsman (oho.qld.gov.au, 133 646), which is the single entry point for health service complaints in Queensland. If you receive services from us under the NDIS, you can complain to the NDIS Quality and Safeguards Commission (ndiscommission.gov.au).
Your consent
Information about your health is sensitive information, so we ask you to give your consent expressly. We do not treat your attendance, or the fact that you filled in a form, as consent on its own.
Please confirm: I consent to Pivotal Motion Physiotherapy Pty Ltd collecting information about my health, and using it to assess and treat me, to keep my clinical record, and to bill or claim for my treatment.
You do not have to consent. You can also withdraw your consent at any time by telling us, and we will explain what that means for the care we can safely provide. Withdrawing consent does not require us to destroy a clinical record we are required to keep.
Where we need to send your information to a funder, an insurer or your employer, we will ask you about that separately, at the time it arises.
Separately, and entirely up to you: our newsletter
This part is optional and it has nothing to do with your treatment. Leave it blank and it will make no difference to your care, your appointment or anything else. We ask separately because your consent to being treated is not consent to being marketed to, and we do not treat it as though it were.
Optional: Yes, I would like to receive the Pivotal Motion newsletter, health and exercise tips, and news about classes and services, by email.
You can unsubscribe at any time using the link in any message, or by telling us. Unsubscribing removes you from the newsletter only. You will still receive the messages we need to send you about your own appointments and account, which are not marketing.
